Please read these Terms and Conditions carefully and sign as they are legally binding and constitute an integral part of your agreement with MYKONOS LUXURY YACHTING. 

1. BOOKING

     .          1.1  These Terms and Conditions and the Booking Form contain all the provisions of your booking with MYKONOS LUXURY YACHTING and apply equally to the Party Leader.

     .          1.2  Your receipt of this Booking Form constitutes our conditional offer for the rental of the Property and of any additional services that you have requested. This offer is subject to our receipt of the Booking Form, duly completed and signed by you within 48 hours of your email of the Booking Documents. If we do not receive the completed and signed Booking Form within the time specified, our conditional offer will expire and your provisional booking will be cancelled.

     .          1.3  Your booking concerns accommodation in a furnished luxury property with daily cleaning and any catering or other auxiliary services that you have requested.

             1.4. The maximum capacity of the yacht is up to 10 guests + 2 crew members and for multi-day charters is up to 4 guests + 2 crew members.

2. PAYMENTS

In order for this booking to be confirmed, we ask that you follow the Payment Schedule which includes 50% down payment within 24 hours of your email with the Booking Form signed and the receipt of the bank transfer. If the payments in the Payment Schedule are not received by their respective due dates, or you violate any other provision of the Booking Documents, the Owner and/or MYKONOS LUXURY YACHTING IKE  reserve their right to immediately terminate this agreement, cancel your booking and refuse you access to the Property. In this event, the cancellation policy as per article 6 of this document shall apply. For charters up to 48 hours before embarkation, cancellation policy written on the booking form will apply.                                                                  

3. BOOKING CONFIRMATION DETAILS

Once we have received full payment according to the Payment Schedule, you shall receive a Full Payment Receipt / Booking Confirmation by email from MYKONOS LUXURY YACHTING. Please read this confirmation carefully and contact MYKONOS LUXURY YACHTING immediately if the information contained there in is incorrect or incomplete.  MYKONOS LUXURY YACHTING shall not be obliged to rectify any errors or omissions that are reported more than 24 hours after the transmission of the confirmation.

4. CHANGES & CANCELLATION

If Guests wish to cancel their reservation, the deposit will be refunded as follows, provided that Guests submit their cancellation in writing (email):

• Upon confirmation the renters are required to proceed to a down payment of 50% of the total value of their reservation.
• In case of cancellation up to 10 days prior to arrival, the amount of the down payment of the reservation is charged as cancellation fees.
• 7 prior days to arrival the renters are required to settle the balance of the second 50% of the total value of their reservation.
• In case of cancellation from 10 days or LESS, prior to arrival, the 30% value of the reservation is charged as cancellation fees.
• Full refund of the 50% down payment will be provided if for any reason that cases increase dramatically and trip becomes unlikely to happen for reasons of Public Health.  The full refund will be provided as long as there will be reasonable notice of 30 days prior to the arrival date. 
• MYKONOS LUXURY YACHTING IKE reserves the right to pre-approve the total value of the reservation from the renters’ credit card.
• We will try to find a replacement client for the Property for the period you cancelled. If a replacement booking is obtained, we will refund the money
paid by you minus any difference between the prices you paid and the price paid by the replacement client.

5. CANCELLATION OR CHANGES BY MYKONOS LUXURY YACHTING IKE

In the exceptional circumstance where we can no longer provide you with the Property booked or the same Rental Period (for reasons other than Force Majeure), you will have the choice between one of the following options:

• Accept an alternative property of equivalent or superior rating for the same Rental Period
• Accept an alternative date for your rental
• If you do not wish to be transferred, we will cancel the booking and refund any amounts paid to us. We Shall not be held liable for any additional cancellation changes.

6. CHECK- IN / CHECK OUT

Please observe the check – in time and check – out times, listed on the Booking Form. We will try to accommodate requests for early check-in and late check- outs, but can not guarantee them.                                                                             

7. USE OF THE PROPERTY

7.1 Only number of guests stipulated on page 1 of this document may occupy the Property. The number of quests staying overnight in the Property may not exceed the Maximum Occupancy indicated on Page 1. In the event that the number of guests exceeds the Maximum Occupancy, we reserve the right to ask all quests to vacate the Property immediately.

7.2 You shall use the Property only for the purpose for which it has been rented to you (personal lodging). It is forbidden to use the premises for any kind of commercial use during the rental (photo shoots, seminars), and / or to hold entertainment parties or function involving a large number of invitees unless expressly agreed in writing by MYKONOS LUXURY YACHTING. Should you make an authorized use of the Property in such a way, we reserve the right to ask all quests to vacate the Property immediately.

7.3 You shall not sublet the Property in any circumstance whatsoever.


7.4 Photographs taken at the Property cannot be used or sold for profit without written authorization by MYKONOS LUXURY YACHTING.

8. GUEST INJURY DISCLAIMER

MYKONOS LUXURY YACHTING and Service Providers cannot be held towards you, the Occupants or your guests for any accident or injury occurred during your stay, under any circumstances.

9. SAFETY

MYKONOS LUXURY YACHTING and Service Providers cannot be held liable towards you, the Occupants or your guests for any loss or misplacement of valuables left in the Property during your stay.

10. CHILDREN

MYKONOS LUXURY YACHTING will endeavor to inform you of the suitability of the Property for children. Please note that the supervision and safety of your children are your sole responsibility.

11. PETS

If you wish to bring a pet, you must ask MYKONOS LUXURY YACHTING for written approval. An additional Security Deposit shall apply.

12. BEHAVIOR

If in the reasonable opinion of MYKONOS LUXURY YACHTING or any other person in authority, you or a member of your group behaves in a manner, which causes or is likely to cause a danger, excessive disturbance (i.e. to neighbors), damage to the Property, or acts in breach of any provision of the Booking Documents, this Agreement may be terminated immediately and you shall be asked to leave the Property. In this event, you shall not receive any refund and you shall be fully liable for any expense incurred as a result of your behavior or the behavior of the persons in your group.

13. DAMAGES / SECURITY DEPOSIT

13.1 The payable amount for Security Deposit  is equal to the amount of one days rent

13.2 MYKONOS LUXURY YACHTING shall check the Property before and after the Rental Period. You shall be liable for any proven damages or losses caused to the Property and its contents. We recommend that you ensure that your insurance policy covers accidental damage to the Property and its contents.

13.3 You shall be liable for all costs related to the loss of any keys provided to you on the first day of the Rental Period.


13.4 Your Security Deposit shall be returned to you at the latest within 15 days of the end of the Rental Period. Potential proven damages or losses as per paragraph 13.1 will be deducted from your Security Deposit In the exceptional case where the cost of repairing / replacing any proven damages exceeds the Security Deposit, you accept to cover the additional cost within 7 days of your notification. 

14. FORCE MAJEURE

If the execution of this agreement is no longer possible because of force majeure, then any amounts paid but no longer justified, will be reimbursed within 30 days of the event causing the impossibility.

15. INSURANCES

You are responsible for your third party liability and medical repatriation insurances. MYKONOS LUXURY YACHTING does not offer such insurances and shall not be held liable for the absence of such insurances.

16. PARTIAL CANCELLATION

A partial cancellation of the provisions of this Booking Documents pursuant to an agreement between the parties or to the decision of a judicial authority shall not affect the validity of the entire Booking Documents.

17. APPLICABLE LAW AND DISPUTE RESOLUTION

All disputes arising out of or in connection with this Booking Document shall be settled by International arbitration, in accordance with the Rules of Conciliation and Arbitration of the International Chamber of Commerce. If no settlement can be reached by mediation, the courts of the place where the Property is situated shall finally settle the dispute.
